LIABILITY NOTICE / DISCLAIMER - App "BetonTage"

1. contents of the app

The “BetonTage” app is used to provide and display information relating to the event (e.g. program content, exhibitor information, hall plans, news/contributions, team and contact information and legal texts). The content is mainly loaded from linked CMS/WordPress sources, in particular from betontage.de (https://betontage.de/) and
betonservice.de (https://betonservice.de/), and can also be displayed from a local cache for better usability.
We assume no liability for the accuracy, completeness and up-to-dateness of the content provided at
. Content may change at short notice (e.g. programme adjustments, exhibitor data, organizational information). In case of doubt, the current information provided by the responsible content providers or the official event information is authoritative.
Insofar as content is not created by us but is taken from external sources, the responsibility for the content lies with the respective content providers. We cannot reasonably be expected to continuously monitor the content of all content taken over without specific indications of legal infringements.
If we become aware of specific legal infringements (e.g. through information), we check the content concerned in the underlying source systems and – where technically and legally possible – arrange for it to be adapted, removed or corrected.
Changes are regularly visible in the app after updating (retrieval/refresh).

2. external sources, external media and references

In the current version of the app, no external websites are opened within the app in an integrated browser or WebView. However, the app can load and display external media resources if these are stored in the CMS content (e.g. images, logos, map/plan graphics). Such resources can be delivered by different hosts, depending on which URLs are stored in the CMS. We accept no liability for the content of external sources. This applies in particular to the availability, technical accuracy, up-to-dateness or legal admissibility of external media resources. External content is always adapted or deactivated via the respective source systems (CMS) or via app updates; direct content moderation within the app is not intended.

3. availability, technical faults and limitation of liability

The use of the app generally requires an internet connection for up-to-date content. In the event of connection problems, maintenance work or malfunctions, content may not be loaded or cached, possibly out-of-date data (cache/stale fallback) may be displayed. There is no entitlement to availability at all times, to uninterrupted operation or to the error-free transmission of content.
We are not liable for damages arising from the use or non-use of the app, from the display of incorrect or incomplete content or from technical faults, insofar as this is permitted by law. Otherwise, liability is governed by the statutory provisions.
This liability notice does not apply in cases of intent or gross negligence, injury to life, limb or health or in cases of mandatory statutory liability.

4. copyright and property rights

The content displayed in the app (e.g. text, images, logos, graphics) may be protected by copyright or other intellectual property rights (e.g. trademark rights). Rights remain with the respective rights holders.
The app primarily stores structured content data locally (e.g. cache, favorites, settings).
Image content is typically loaded as network resources via the URLs stored in the CMS content
. Source and rights notices are displayed insofar as they are contained in the content provided.
Any use, reproduction, editing, distribution or other exploitation of content outside the statutory limits of copyright law requires the prior consent of the respective rights holder.

5. contact details / advertising objection

Insofar as contact and imprint information is displayed in the app (e.g. as contact information taken from the CMS), the use of this data for sending unsolicited advertising and information material is expressly prohibited. We reserve the right to take legal action in the event of the unsolicited sending of advertising information (e.g. spam).

6 Notes, messages and corrections

If you notice any incorrect content, copyright infringements or unlawful representations, please notify us via the contact channels specified in the legal notice or in the contact information. We will check reports as far as technically and legally possible and, if necessary, arrange for corrections to be made in the source systems so that they are also visible in the app after the next update.
